Any assault charge in New York is very serious. One is charged with assault when they cause physical injury to another thru the use of physical force.  Assault offenses range from misdemeanors to felonies. Each of them carry the potential of jail exposure. There are a series of factors that can increase the severity of the charge that one faces and consequently enhance the amount of time for which they can be incarcerated. These factors include one’s intent, the use of a weapon, the presence and actions of additional perpetrators and the degree of injury the claimant suffers.

Drugs


Drug offenses encompass the possession and sale of controlled substances, examples of which include Marijuana, Cocaine, Heroin, Methamphetamine and Ecstasy.  The totality of substances that can trigger an arrest under the existing statute can be found under Schedule 2A (of the public health law).

Weapons


A variety of circumstances can give rise to a Criminal Possession of a Weapon offense(CPW).  A traditional CPW offense arises when one is found to be in possession of an item that has been designated to be a dangerous instrument or deadly weapon. CPW offenses range in severity misdemeanors to felonies. A conviction under any section exposes one to incarceration.

DWI Offenses


DWI offenses can result in serious consequences for the accused. Beyond losing the privilege to drive, misdemeanor and felony DWI convictions can result in jail time. DWI offenses are defined under section 1192, which reads as follows:


Criminal Mischief


One is charged with Criminal Mischief when they damage property belonging to another. Criminal Mischief offenses range in degree of severity from the level of misdemeanors through felonies and may result in jail time.  Criminal Mischief is defined under penal law section 145.00, which reads as follows:

Robbery


Robbery is forcible taking of another’s property. All Robbery Offenses are felonies and expose the accused to lengthy incarceration. The severity of the offense is enhanced by factors including but not limited to the use of force, presence of additional perpetrators and use of a dangerous instrument or deadly weapon.


Burglary


Burglary is the unlawful entry into the home or place of business of another with the intent to commit a crime therein. Every charge of burglary is a felony. The severity of the offense is enhanced by factors including but not limited to the use of force and the use of a dangerous instrument or deadly weapon.


Larceny


New York State separates larcenous offenses into the categories of Petit Larceny (misdemeanor) and Grand Larceny (felony). Petit larceny involves taking the property of another without their permission or authority.

Grand Larceny is a felony offense that stems from the taking of another’s property worth over $3,000 without their permission or authority.  Grand Larceny also includes using one’s personal information, BANKING INFORMATION, or a credit card issued in their name to complete a financial transaction.

These offenses are distinguished from Robbery in that the crime must be committed without using physical force against the Complainant.


Homicide


There is no charge treated more harshly under the law then homicide. Homicide is the killing of another person.  There are various charges of homicide including manslaughter,which are not intentional, and murder which is intentional and even justifiable homicide. There are also many defenses to these charges, one of the most familiar being self-defense.
